The President of the Republic did not promulgate amendments to the Dwelling Act concerning rent ceiling03.08.2004
President Arnold Rüütel on the basis of § 107 of the Constitution refused to promulgate the Act on Amendments to the Dwelling Act and to § 12 1 of the Republic of Estonia Principles of Ownership Reform Act passed by the Riigikogu unamended on 20 July 2004. The President of the Republic appealed to the Supreme Court proposing to declare this act inconsistent with the Constitution of the Republic of Estonia.
When making the said decision, the President of the Republic noted: "The ownership reform launched in the course of restoring Estonia's independence has to be completed in compliance with the objectives of the ownership reform and respecting the constitutional bases of our legal system. According to the Constitution, the review of the constitutionality of legislation falls within the purview of the Supreme Court."
