The President of the Republic rejected the promulgation of an act

President Arnold Rüütel this morning at Kadriorg signed a resolution not to promulgate the Act on Amendments to the State Budget Act and to Other Acts Arising therefrom, passed by the Riigikogu on April 17, 2002.

Explaining his decision the Head of State produced the contradiction of the Act with § 115 of the Constitution, pursuant to which the Riigikogu shall pass as a law the budget of all state revenue and expenditure for each year. Whereas the new wording of § 4, subsection 3, excludes from state revenue state fees and fines, it violates the principle, set forth in the Constitution, of the budget being all-embracing, uniform and transparent, and thus, restricts the powers of the Riigikogu as legislature to get information and to decide, on the basis of that, the appropriation of all state revenue and gain.

The amendments to the Act would authorize the Government of the Republic to structure the major proportion of the state budget using the Government budget, thus diminishing the control by the Riigikogu of the necessity and practicality of the state expenditure. This kind of regulation is inconsistent with the Constitution. Furthermore, it contains a contradiction with the provisions of the Constitution stipulating that the state budget passed by the Riigikogu shall enter into force at the beginning of the budgetary year.

The President deems it necessary that the Riigikogu discussed the Act on Amendments to the State Budget Act and to Other Acts Arising therefrom anew and brought it in line with the Constitution of the Republic of Estonia.
