The President of the Republic met with the Constitutional Committee of the Riigikogu

President Arnold Rüütel met with the members of the Constitutional Committee of the Riigikogu at Kadriorg today and discussed with them the further legislative proceeding of the draft amendment to the Constitution, introduced by President Lennart Meri to Riigikogu on 8 October, and the issues raised in that draft act.

The need for a constitutional court and its possible role in the Estonian society were discussed. In the opinion of the members of the Riigikogu, the constitutional court presented in the draft act is necessary for settling the complaints between state institutions and local governments for the protection of their competence. Creation of the constitutional court would provide above all to individuals an opportunity to file complaints about violations of their fundamental rights, if there are no other opportunities for legal protection or they have been exhausted. At the same time they considered the possibility for delivering the competence to the Constitutional Review Chamber of the Supreme Court of Estonia.

The President of the Republic was interested in whether and in what way the Constitution would have to be amended in case of accession to the European Union. The members of the Committee admitted that the subject had not been thoroughly attended to yet at Riigikogu, but that political discussions would have to be initiated in the near future.

The draft Courts Act currently undergoing legislative proceedings in the Riigikogu was also talked about. The participants of the meeting were of a common opinion that a new meeting should be held in the near future on the subject of the independence of courts.
